Not saying that the other OEs do not do some questionable things, but this is pretty bad.

Yeah, they screwed up pretty bad. What I don't understand is why didn't they just leave it set on the tune for emissions and forget about the other one? Or was it that way so they could get the great gas mileage?

Yes. MPG too. The clean setting was performance and economy down. And harder on the engine AIR.

They are going to get an epic fucking by the EPA and in this case I think they actually deserve it. They defrauded buyers completely and knowingly.
