You got to come up on the details on how this happened:confused:. How did he lose control of his car. I can't beleive that he even concidered not giving you his insurance informaiton. I would have asked him once, then called the cops, then commenced to cave his face in like the front of his car:mad:. Were you in your car? At least you're ok:bigthumbsup:.

:iagree: Always get a police report. Always. Always. The driver at fault will almost always deny fault after the accident, you need to get a police report, on the scene. Don't even move your car. Don't let them move their car, I don't care if he's in your Evo club. Always get a police report.
Getting a police report has nothing to do with the insurance company. If they want to pay you directly and not report it to the insurance company, that's fine, but you still get a police report.

Sadly, depending on where the location is, the police won't always take a report. I'll give details later about an experience I had.

oh dude it gets better man!!!
so this happend at a jack in the box parking lot where the local meets move too once the original spot gets broken up by cops, to i roll into the parking lot and i see another evo friend parked n the other side of the isle im currently stolling so i say imm park next to him, so i go around and when my nose is poking out the other end i stopped because this blue evo is chilling there talking to the guy i wanted to park next to which os about 6-8 car parking spot to my left. well i think that he is gonna park or something o i chill where im at until he does something, well he pulls forward some about 3-4 parking spot and i still think that he is just gonna reverse into a parking spot, well by the time he gets 2-1 parking spots away from me i realize hes not gonna stop and it was to late for me to get in reverse and take off and he hits my front drivers side tire/fender/bumper like as though he didnt see me there.
so im about to fuckin cry because for anyone that knows my car history know that this evo will be my last chance at greatness and that my insurence company hates me, ive totalled 2 eclipses, and 1 evo, and have 2 points for speeding but not in any of my cars its been in my moms suv? go figure! anywho they hate me and i dont want another totalled car!!! and knowing how well the evo crumples like a coke can at 5mph collisions i freaked out!!! and thought my car was gonna be fked up!!!
well no my car was relativley ok when i got out and his car was fucked up lol!!!!
what ended up happening was because i was trying to turn left my tire was fully facing to me left and he ran the fuck in that, so his front end literally ate my tire and tapped my bumper, fender. and i was mad happy!!! :-D
so anywho i get out and this guy parks and u can hear his radiator fan hitting his intake and intercooler piping!! we try to pop his hood but its fuckin jammed so he ended up kicking it up and found that his radiator support area had bend inward also hid intercooler is bent in and punctured his ac cooler core * i forgot the technical name lol* and made a small hole in his radiator.
and to make shit even better a fontana police officer was there watching the whole thing and laught at me when i got outta the car and called me a fuckin idiot and said thats wat i deserve....and then proceeded with a "u fuckin street racers make me sick!" and then left :-) o joy!
so i start talking to the guy and take pics and he really was trying to contemplate not going threw the insurence and fixing my car with out right money *trying to screw me over* but im like dude look at ur fucked up car really more so for ur sake go threw the damn insurence because ur car is gonna be a handful to fix.
so after a while of repeating the same thing to him his g/f says fuck this ust do it threw the insurence and she gives me his card and drivers licens and other info and we swap.
then she says * his g/f* that we should call the cops just to get a report to make things more official and easier, well she calls the police and guess which cop shows up the same one that saw everything and called me an idiot for an accident i didnt cause?........so anywho me and the other driver go to the cop and say hey can u make us a report so we can get this done with and go home, the cop proceeds to say fuck u, u guys are fuckin idiots im not gonna waste my time on writing a report for u faggot street racers on something that was so stupid, he said u guys got what u deserve and then he asked us where we live and we both said rancho cucamonga, and then he said well get ur mess cleaned up and get the fuck outta my city before i arrest u two! followed by a dont ever let me see ur faces again at this street racer meet up spot again or ill make it a point to impound and crush both your cars! then he drove off into the night!!
well im standing there like wow and people wonder y cops are dislike and feared alot by the general public? if i remember right there was a latin comedian i forgot if it was george lopez or someone else that said something in his show along these lines ," back in the day when i was a kid you felt safe and comfortable when there was a police officer around or coming behind you on the street, but now a days most people feel scared, and stressed or uncomfortable when they see the presence of an officer around they might not even b doing anything bad or guilty of anything but thats the mass mindset now and officers gave that to themselves!"
anywho so now just to be nice i wait till this kids tow truck arrives to take him home, and we chit chat and i try to make him feel better about it and see everything will be cool man whipe that i cant believe this happend smile off your face. so the tow truck comes and a san bernardino sherrif shows up to see whats all the commotion, and we ask him about writing a report and he was cool and nice and said actually if it happend in a parking lot then technically they dont write reports for that being as how it didnt happen on a public road and we say thanks for the info and droping by and he leaves on his way. so im like wow the other cop couldnt tell us that in a more normal way?
and right as his car is getting towed up i ask him so wats ur vew point on this whole thing and he said this........that he was talking to a friend in the other evo, then started to pull forward and then a passenger in his car stated that there was a cop in the parking lot so he was looking around and still driving forward and by the time he noticed he was gonna hit my car it was too late. he even added this that he tryed to stop so hard that the tires hit a puddle that was on the floor and it made him lose traction to brake faster and in a shorter distance. and im like wow!!!! really? u have the same pro ass awd/ brembo break system i do? if your going 15-20 in a parking lot and u hit a 1ft X 1ft puddle on ur drivers side front tire ur not gonna lose traction and slide to a stop in a fuckin evo!!!! WTF!!!
anywho after that i just went home pissed.
MY CAR!! :-D

Sounds like a bunch of bullsh*t to me. Lazy f*cking cops. Of course they can write a report on private property, that is the dumbest thing I've heard all night. If you shoot a woman in the face (gotta love this analogy) in a parking lot, will the cops say "hmmm, geee... too bad it happened on private property, my hands are tied."? I'll bet if you claimed injury (not that you should have) he would have gotten off his lazy ass and written a report.
The first cop was just a dick. They're out there. Some are cool, some are attracted to the job because they have issues and need the power to feel good about themselves.

In that case, I ask for their badge number and the name of their superior officer along with how I can contact that person. It has helped change the attitude of a cop on the one occasion I did so. Just do it in a polite and respectful manner, it helps add to the effect.

Sorry dude, cops are law enforcement. The enforce the California Vehicle Code, which applies on public roads, not private property. (That's why your ten year kid can drive a truck on private property and that can't/won't say anything, among other things.) Shooting a woman in the face is pretty much illegal everywhere. This has been my personal experience, what I've heard all my life, what the people here are saying, and what I learned in traffic school recently. :sm_up_there:

If you destroy someones property or cause someone injury anywhere on US soil, I believe that a cop can write a report. That was my point. In a parking lot the cop will not be able to say, Bob was in violation of penal code blah bi di blah. But like I said if someone claims injury, in a car crash, how would a cop not be 'allowed' to write a report? If I took a bat to your car in the parking lot, who would you call? Ghost busters? What if instead of a bat, I used my car...

Your analogies are weak sauce. Bottom line, whatever you want to believe, if a car "accidentally" bumps into another car on private property, like your drive way, the cops aren't going to write a report. Period. End of story. If someone takes a bat to your car, that's vandalism, and possibly something else criminal. If someone intentionally hits your car with their car, likewise, probably something like vandalism or vehicular assault. Accidents where there are no injuries on private property, the cops are just going to say go pound sand . . .every time. Find me the law where it says they have to take an accident report where vehicles ding each other on private property and there are no injuries. If it's a required procedure by law, its defined by the legal code. Right?

Did I ever say that police reports were mandated by law? Don't think I did... I doubt that most SOPs for cops are mandated. I said, and still believe that it is at the cops discretion, and the cops are well... f*cking lazy. They don't care about your car, why would they? I'm sure it depends on the cop, and from his point of view the situtation, but if you can get one, get one. Do everything in your power to get one. Why? Because in court, it is you against the defendant and if they don't agree with you and admit fault (even if they change their mind after the fact) your word means jack sh*t. A cops statement on the other hand, is gold. I've seen far too many disputes that could have been sooo easily clarified with a police report. Take my advice or don't, I don't really care... sorry. :sm_up_there:
As for weak sauce, your example is ten fold weak sauce! Haha. Whether the car crash was intentional vandalism or not it is NOT up to the police officer to decide. Remember that innocent till proven guilty thing they always say on Cops? It's his job to write an objective report that the judge can read through when your checkbook (or your ass) is on the line. IMHO. :afro:

im gonna try and work another angle that isnt so fraud like. hear me out
so because my rim was defaced in this situation im gonna be getting a new rim regardless, but my tire is was past bald on the inside because of an already tad bit off alignment after, im thinking that when the new rim shows up they arent gonna wanna throw on a bald ass dangerous tire on my car......and to make it even worst im gonna have to get rebalanced and aligned anyways because the impact already threw off my alignment so how could they justify correcting my alignment with a messed up dangerously low tire that cant be fully aligned correctly because its worn unevenly and is dangerous to re-install and drive on?
so i will be needing a new tire regardless kind off? and try the same old awd cars need all consistant tires or else youll get drive train problems down the road story to get a new set?
how does this sound? if they shoot me down no big deal if they take it then hooray and nothing was messed with outside of the accedent?

I understand your point. Here's your power: call a cop. Here's what the say: nobody hurt? private property? have a nice day. The end.
I've had a fairly unpleasant accident coming off an off ramp and into an intersection. I called out the CHP. He said because the contact occurred in the intersection it was out of his jurisdiction. He also said (this was in Irvine), don't bother calling them. Because nobody's hurt, they won't come out. This was on public roads for fu*k sake. And yes, the bastard did later try to sue for injuries later. Fortunately, my insurance (who took a report immediately from both of us I presume), told him to go pound sound and get lost.

its the other guys insurence they made me go see one of there repair shops for a quick over view.....im pissed at what they estimated for my repairs,
the past primer scratches and the warpage under my headlight the guy wrote buff it out,
he didnt even mention my rim in the report, for the mega deep and wide scratches on my headlight he wrote buff it out?
for my fender i think there gonna try and hammer it straigh? WTF!!!!
the only good thing that came out of it was that for the alignment he wrote and any other fees that may result from it. :p
but ya on the paper he gave me it says his estimate is 1500 dollars? WTF!!!
1000 for labor, 300 for repairs, and the other 200 was on like misc...? dude no joke there trying to shaft me fuck them!
i know its gonna be found in his fault*the other driver* and imma take my car to a crazy expensive shop i know that did alot of body work on my dads truck when he got hit and they said they would clean up my whole car if i ever bring them an insurence job like my dad did.

Ben, that blows. I had no idea that the local cops were so useless. I'm glad you didn't get sued.
Cornfed, this I know... You can take it to any repair shop that you want. They have no right to tell you which shop to take it to, to get three estimates, anything of the sort. Find the best and likely the most expensive repair shop that you can, demand to take it there, it is the law. Do not be fooled by them, their sole job is to screw you.
If you want a new panel, a new rim, tell the repair shop that you will not give them business unless they justify getting you a new part. I know a shop in Anaheim Hills that will get you a new panel if you take it there. Don't let them fill it. It will likely never look the same, I have fun spotting repairs on the road every day.

CornFed,
To give you a little backround, I've been an auto claims adjuster for 2 years now...In order to properly help you, I have a few questions for you.
1) Was your car stopped or parked when it was hit? Was your car moving?
2) What insurance carrier do you have? What insurance carrier does the other party have? Depending on the company....(if it's mine) I may have very limited access to the claim but I may be able to check the status for you.
I'll try to go through this as easy as possible without being what my husband calls me "an insurance nazi."
If your car was parked or stopped, no liability (fault) can be put upon yourself for the accident. Again I don't know the facts of loss, so I'm only assuming at this point. If you were to use your insurance to repair your vehicle (providing you have that kind of coverage - collision) most people tend to think that it's going to affect there record or premiums. Incorrect! This is a big missconception. You have insurance for a reason...to help you in times of need or repair. Premiums would be reviewed or adjusted if one or possibly both of the following:
a) an accident is 51% or more your fault
b) tickets or citations
What else,....oh yes your lovely tire cituation. Within insurace there is this lovely little thing that is called "betterment." Betterment is technically explained as this. If you have a part of your car that wear and tear can be put on it such as tires, mufflers, exhaust, that insurance company is not going to pay for the wear and tear you have already put on it. So with your situation....they "might" (when I say might...some adjusters that come out to write the estimate might just "overlook" how much tread you have on your tired) but if you get a "by the books adjuster" they will measure how much tread is on that tire, charge you for how much tire you have aready used (it's in percentage form) and then put the new tire on the car.
Does that make sense?
Betterment also applies for previous damage. Say you have a scratch or a dent already on your rear bumper and someone rear ends you. That inspector/insurance company might charge you say half of the bumper b/c with your prior damage you would have to repace teh bumper anyways but yet you were rear ended.
It's crazy.....stupid, rediculous, nutz, and petty, but if you really think about it....it makes sense no matter how dumb it might be.
What else.....oh yes insurance fraud. I'll pretend I didn't read anything posted in this thread...hehe but just for future refrence to any and all who read this. Fraud if you wish to partake, that is your decision. Just be cautious. If you want stories...i have stories, but not enough time to share.
Please let me know if you have any more questions or need any help. I think I'm going to make a thread in the BS lounge about insurance claims questions to help field some of them.
Keep us posted on your claim....take care!

CornFed,
To give you a little backround, I've been an auto claims adjuster for 2 years now...In order to properly help you, I have a few questions for you.

Oh yeah, I knew there was something I was missing.
Body shop...legally we can't force you to go to our body shop (any insurance for that matter). The reason why we "suggest" our body shop is because we guarantee the work done by that body shop for the life of the repairs. They also will release a vehicle with out payment. Now say you want to use your body shop that you dad used that charges more. You are more then welcome to use them...BUT it's not going to be any different then if you use the Mercury or State Farm shop. Both companies are going to send an inspector to the body shop that you have picked write an estimate (mercury or state farm inspectors) have the shop approve it and then the shop works off the estimate that the insurance companies give them. If you use Mercury to repair the vehicle, you will be without your car for a day while doing the inspection at your own body shop. You will also want to inquire with the body shop if they guarantee the repairs that they do to the vehicle.
Deductible.
If you decide to open a claim with State Farm yes your deductibe will apply. Now with Mercury these are our policies (if you were our insured). If the other parties insurance accepts 100% liability then we would waive your deductible. I don't know what State Farms procedures are but the only way to really find out is if you open a claim with them I suggest waiting ...it appears that your car is driveable (from the pictures) it just looks ugly.

I put an email out to your adjuster to see if she will release her liability decision.
If it makes you feel any better in the mean time, he caused $3500 in damages to his car....
lol nice thanks for the help.....and to tell you the truth i feel like he did more damage then that. hell i had more damage then what that guy claimed.....they just did a quick look and i know when you take his car apart there will more like i said i believe that kid has frame damage.......but still nice to know i wanna just get this whole thing over with as soon as possible.
on a good note i actually got enough money for my gangster clutch, a dual fuel pump, 1200-1600cc injectors or 114lb - 152lb injectors, and maybe some tires if the insurence claim doesnt pan out  i felt like a drug dealer taking all that money out at once :D

I'm guessing witnesses, preferably ones that aren't either of your friends, are going to come in handy. Didn't the insurance take a statement within a couple days after the accident?

If you record a conversation bring a friend, if there is someone else there he has no reasonable expectation of privacy and you'll be able to play the recording in court. Otherwise you might not.
Or maybe try to get him to reply to a text that will condemn him. This is exactly why you should always get a police report, too bad the cops on the scene were too lazy. :barf:
