Yea...I lived ......are you ready for this...the lead Fed called me articulate....:sm_laughing:...he wants to question me more on the business practices of the company.

The company was making a Million dollars a month....damn I didn't get any:rant:

As far as to why speculation is everywhere...suppose to get paid tomarrow.....now we have nothing and may never get paid.:(

Sounds like money shenanigans at the top. As for pay for time worked, that might be a question for enkeivette. I'm not sure what status the business is in now, totally frozen? Then you're probably screwed. If there are plaintiffs and they win, they get the damages, if that liquidates the company, employees are hung out to dry I would imagine. But I might be wrong.

If the Feds haven't frozen the accounts the CFO, or COO should be able to unilaterally authorize AP to run payroll.

If the company was organized as a C corporation, and by the sounds of it I can't imagine it wasn't, that specific entity would be isolated from personal accounts. All I mean is that it's possible for personal accounts to be frozen and the corporation to continue operations pending investigation. If it was a sole proprietorship, or S Corp, or not registered as an entity at all (almost impossible to imagine) then it may be a different story.

I recommend you ping enkeivette about the situation and what rights you may have under the law to seek your compensation for work rendered. It's not so common that powers will say "hey, here's your due." He works affordibly for friends, is excellent (I've used him a couple times) and if you have thousands or even hundreds of dollars pending I think it is absolutely worth a chat. I have no idea what is or isn't possible, that's what the experts are for. Just don't wait and think the Feds give a shit about you. They don't. They want "THEIR" money first. You're an afterthought at best. Sorry to be brutal about it, just want to see you settle up at least.

Ben, read about 'piercing the corporate veil,' thats why you hire someone like me to write your articles ;)

As far as Glenns compensation, it will depend on the types of shenanigans. If the corp money was considered stolen, than it never had title to the money, and thus Glenn would be suing a penniless corporation. Id try to shmooze with your payroll person and see if you can get yourself a check. Because the alternatives are bleak and difficult.

If thats not possible, hit me up and Ill see what I can do.

Glen, I'm sorry to hear about this. I, for one, could do without this kind of excitement. Got plenty of stories. Don't need to add to the collection. I'd rather have the job.

Well, if the work itself was on the up and up and the shenanigans were all behind the scenes, your work experience is still valid. Consider hitting up all the places that do even vaguely similar work ASAP and see if they have openings. If you want something go get it. :vikings:

For fuck sake, take advantage of friends! What else are they for? Duh! ;)

I'm sure Adam would be happy to chat on the phone for 15 minutes after you know more. If it seems like you have a strong case and no money, maybe you can work out a contingency basis.

Trust me, there is all the world of difference from trying to go it alone and sending a tightly reasoned legal argument on attorney's letterhead and you probably have a short window of time to act after which it won't matter at all if the entity is dissolved; there will be literally nothing to collect from. You want as much of your money as possible as soon as possible and to move on.

Sorry to be preachy. It's my best advice. Do as you see fit.

Hate to rain on your parade even more but I know of 2 cases in CA where the feds or major creditor closed a business. Creditors and the IRS come before the employees.

In the beginning Incs were only temporary businesses to due business with the govt, now they are forever and the execs are very seldom held accountable. They rake in their 6 and 7 figure salaries all the time knowing the business revenue is not enough to cover it all.
The corporate vail needs to be burned at the stake.
