Yep, some asshole pulls in front of me in a parking and I hit him at 15 mph. He all real sorry and all saying it was his fault over and over again. His left front fender is crushed. The T-bird looks like it bumped into something. Very minor damage to front of Bird. Bezels not even bent bad. Just moved my fender back a 1/4 inch and moved the bumper over 1/2 inch.
His Accura looks like it was hit by a train. This sucks. The body on the T-bird was almost perfect till now.
I just have minimum liability coverage. I hate this shit. The guy has Farmers Ins and I have State Farm.

I'm sure my wife will chime in, but if he's at fault I would think his insurance should pay to get your car fixed

Just got done with talking to my Insurance Co. They were very pleasant.:bang:
Love to hear what Alexis has to say on this. :D:thumbs_up:
The guy was real nervous. He let slip this is his second left front fender he had to replace.:bang:

Sorry, I’m Here Are Work So Please Excuse My All Caps…i Have To Look Like I’m Working And This Is How We Put In Notes...in All Caps.
Lets First Start Off With How The Accident Happened.
So You Were In A Parking Lot Correct?
Were You In A Parking Aisle?
Were You Pulling Out Of A Parking Space?
Where Exactly Where You In The Parking Lot?
Was It A Main, Parking Aisle (one With A Lot Of Traffic) Or Was It A Minor Parking Aisle?
Where Did The Other Vehicle Come From? Left Or Right? Did He Have A Stop Sign? Did You Have A Stop Sign?
In My Experience Of Parking Lots, It’s Best If You Draw A Diagram And Submit It To Your Insurnce Company So They Will Have A Copy Of Your Version. It’s Very Hard For Us To Pull Up Any “google.com” Maps As They Can’t Zoom In Close Enough Or Get A Good Street View (an Option Google.com)
What You Might Also Want To Do Is Go Take Pictures Of The Intersection And Also Submit Those To Your Insurance Company. The Quicker The Better, That Way They Can Fight For Your Side.
If You’re Able To Upload A Diagram As To How It Happened Or Maybe Even Fax It Over To Me At (714) 255-5033 Attn: Alexis Plunkett, And I Will Be Able To Further Assist You.
Lets First Start With How It Happened And Then From Here.
Ps - State Farm = Good
Farmers = Pos! Hate Them Suckers...they Deny Everything, Including Our Claim With The Cobra That We Won In Court. If They Deny, But Your Insurnace Company Feels That You Are "not" At Fault, Unfortunately, You Will Have To Take The Acura To Court If You Want To Get Your Money Or Car Fixed B/c State Farm Will Not Pay Anything Out On Your Car (i'm Assuming You Have Liab Only On The Thunderbird). Long Story, I Can Explain Later.

I got your fax...
What are the major x streets? I want to see how close I can pull in a map.
Did you or the other vehicle have a stop sign?
It appears you were in a main aisle way in the parking lot, is this correct? 1 lane in each direction?
Looks like claimant (other party is at fault).
PS - GOOD MAP! I have seen some pretty F-D up maps. I can actually make out what you mean. :P

The stopping Center is on the North West corner of Yorktown and Gothard.
Correction on map. I was heading to the Goldenwest exit not Gothard. My Bad!
Yes, the main drive thru of the Shopping center--two lanes one for each direction.
What he came out of was between two islands. Don't know if he had a stop sign or not. He was stopped then just turned out in front of me.
Thanks Alexis.

Ug I can't attach the print screen. Were you exiting the parking lot towards a baseball field? I think I found the location but like I said, google.com only can show me so many "street views."
If everything you've told me is correction, the other party is 100% liable for failure to yield. Now lets just see what Farmers has to say.

The baseball field is about a mile north of the Shopping Center. Goldenwest is on the West side of the Ball field.
Everything is as I told you. What gets me is, he looked right at me and made eye contact. Then he just pulled out in front of me.
I talked to State Farm's claim people. They have already sent the guy a letter. If he tells the truth then everything will be fine. If he lies, I have his address off his DL.
I almost beat this guy to...... well you know. It took everything I could do not to hurt him. He kept saying it was his fault over and over again and how sorry he was. That probably kept him in one piece.
Thank you for helping me out here. Sean is lucky guy!

I believe you just won your case sir!
Please google.com this address:
19350 Goldenwest St, Huntington Beach, CA
Then do a satellite view, and zoom allllll the way in. You will find that he had a stop sign!
Zing! Failure to yield written ALL over this one Glen.
Print the google.com map out (you'll need to print screen probably to get the satellite view). If you can't do it, I've just printed it out and I will fax it over. But the quality might be pore. It's best if you can print it (I can mail it as well if you need, but I need an address).
MAKE SURE you give a copy of your diagram and google.com map to state farm. This will help for sure!
Now for the damages to your car...
Once Farmers decides they are at fault, I have no clue if the damages will total out the vehicle. You can definately take the check and fix the damages on your own, but again, I don't know if it give the car a salvage title. :(

Alexis:
The damage is very little to the T-bird (if the front end is not pushed to one side). I may need a headlight bezel. The fender just needs to be loosened and moved a 1/4 inch foward and a small crease pounded out. The bumper needs to moved a 1/2 inch to the right. The front header is pushed in some, just need to pull it out. No major creases to the body line.
Like I said minor. They give enough money for labor and the bezel and I'll be happy.
I'll get that map printed.
Thanks for you help.:drink::drink:

You've made me feel a little easier about this. The last time I battled an Insurance company was in 72 and that was with Allstate. I won that case after a battle. That was a messy accident. This guy pulled out of a driveway from his doctors office and I hit hit at about 50 mph. What a damn mess. They tried to total my Vette. After a number of meetings and arguments, they finally gave in when all my wittnesses statements came in.

Well the asshole showed up. The first question he asked me was what I though the T-bird was worth. I told him I was offered $6,000 (which I was). But, I wouldn't sell it because it's been in my family since it was new. He just started to take pictures of the car-the whole car. I told him that there was no damage in the rear as he took pictures around the car. I told him this was an on going project. He asked me to let him take pictures of the mileage odometer, I open the door and he starts taking pictures of the interior. He didn't even take a picture of the odometer.
He was not even interested in the damage to the front.
Even a dumb shit like me can figure out what he was doing. They want pictures to try and total it or find a way for reduce the amount they will have to pay.
I blew it, I told the SOB don't even attempt to total my car for 2,000. You tell those Mother Fuckers at the office don't even think about. I won't be Fucked with. I think he was afraid for his life. He kept backing up and finally said in a little tiny voice I'm going to turn around and walk away.
I told him from the beginning that my Mother me gave that vehicle before she died and asked me to fix it up. I'm keeping that promise.
Now, I have to figure out what to do next. I'm ready to kill something. I'm not kidding here. I hate being Fucked with.

Just keep the faith, Glenn, and don't take their shit. I had my insurance company try to lowball me when I wrecked my 68. I made them go to arbitration and wound up with $17K more than they offered me originally. It took awhile and it was a pain in the ass, but in the end I got a fair settlement.

Your Rights Under the Fair Claims
Settlement Practices Regulations
In general, insurance companies are required to do
the following:
• Advise you of all benefits, coverage, time limits or other
provisions of your insurance policy.
• Acknowledge claim, start investigation, provide forms
and instructions, and provide reasonable assistance
immediately but in no event later than 15 days after
receiving notice of claim. (Notice of claim is any written
or oral communication to the insurance company which
reasonably apprises the insurer that you wish to make
a claim.)
• Respond to communications received from you
immediately but in no event later than 15 days.
• Accept or deny the claim immediately but in no event
later than 40 days after receiving proof of claim. (Proof
of claim is documentation in your possession which
provides any evidence of the claim and supports the
magnitude or the amount of the loss such as estimates
of repair or police report indicating theft of your
vehicle, et cetera.)
• Unless the insurer has provided you with the name
of a specific towing company prior to your using a towing
facility, the insurer must pay reasonable towing expenses.
So you’ve had an automobile accident. What’s next? 11
• Offer a fair settlement. If you suffered a total loss,
settlement must include taxes, license and transfer fees.
The settlement must reflect the value of a comparable
vehicle of like kind and quality. If you retain the salvage,
deductions from the settlement for salvage must be fair,
measurable, and discernable.
• Once the claim has been accepted, the insurer must pay
the claim immediately, but in no event later than 30 days
from the date settlement was reached.
• Advise you whether or not they will pursue subrogation.
If the insurance company pursues subrogation, they must
include your deductible unless you have already recovered
your deductible.
The above represents a paraphrased brief overview of some
of the Fair Claims Settlement Practices Regulations effective
5/10/97. You may view a complete copy of the Regulations

Yeah, I quit doing that. I have a tendency towards violence and got locked up too many times because of it. Funny thing is, I haven't been locked up once since I quit doing shit like that. I kinda like not being locked up.
You might have a good point there. But, I have developed a little technique that works with out laying a hand on anyone.
I have used it to help people collect money owed.:sm_up_there:

One of the things that has helped me to not be violent anymore is to stay away from situations that will trigger that response in me. It's just easier for me that way.

Well, I gave my contact at Farmers a call today to see what's up. That was at 8:30 am and was told she would call me back. Still haven't heard from them.
Is this a common with Insurance Companies to do this crap?:censored:

Call back and press zero, ask to speak with a supervisor. I would advise to call back after lunch. We have time lines according to the dept of insurance in which we have to return phone calls in. If you are documenting all your calls that you have made, you can let them know that you called on x at x exact time, and have not rec'd a call back from x and would a status on your file.
Sorry I haven't been much help lately...I've got a grip load of claims these days. Some 7 car pile ups, serious injuries, and so on. They are getting all my time. :)

Just got off the the phone with Farmers Insur.
Still giving me the run around. Got the forms for the Insurance Commissioner to file.
They are stating I'm not cooperating. But, I have. They don't want to pay the Estimate of the damages. They say the T-bird is not worth the cost. Just what I figured they would try and pull. So here we go........:censored:
I guess they figure I would just go away.

Well, maybe not yet. I've got him on the run. Now to E-mail his company about his non-professionalism. :pot_stir:
I really don't want to bother her on this if I don't have too. I'm sure she has other things to do than be bothered with this.
